OpenAI has filed a counterclaim against Musk: the company accuses him of harassment

OpenAI Corporation has filed a counterclaim against billionaire Elon Musk, citing systematic harassment by him. This was reported by Reuters.

OpenAI claims that Musk has “tried all available tools” to harm the company. In the statement, the judge is asked to stop the entrepreneur from “illegal and unjust actions” in the future and hold him accountable for what he has already done.

“[Musk is acting against OpenAI] through malicious campaigns broadcast to Musk’s more than 200 million followers on the social media platform he controls, a spurious demand for corporate records, harassment lawsuits, and sham bidding for OpenAI’s assets,” the statement reads.

In response, Elon Musk’s legal team recalled his recent offer to buy OpenAI for $97.4 billion, which the company rejected.

“If the OpenAI board of directors had considered this offer, which they were obligated to do, they would have seen how serious it was. It’s telling that the need to pay fair market value for OpenAI’s assets is supposedly ‘interfering’ with their business plans,” says Musk’s lawyer, Mark Toberoff.

OpenAI posted on the X platform, calling Musk’s actions “unfair tactics” to slow down the organization. The billionaire was accused of trying to seize control of leading AI innovations for personal gain. The agency writes that the parties are scheduled to begin a jury trial in the spring of 2026.
